2. Description of Services
Holiday Fridge provides a concierge grocery delivery service for travelers staying in holiday accommodations in the Costa Blanca region of Spain. We source fresh groceries from local suppliers and deliver them to your accommodation prior to or during your stay. Our services include:
- Pre-arrival grocery shopping and delivery
- Curated starter packs with local Spanish products
- Custom grocery orders based on your preferences
- Coordination with property managers for access
3. Orders and Payment
3.1 Placing Orders
- All orders are subject to availability and confirmation
- By placing an order, you make an offer to purchase goods subject to these terms
- A contract is formed when we send you an order confirmation email
- We reserve the right to refuse orders that exceed typical consumer quantities
3.2 Prices
- All prices are displayed in Euros (€) and include IVA (Spanish VAT) where applicable
- Prices may change without notice, but the price at the time of order confirmation applies
- Delivery fees are shown separately during checkout
3.3 Payment
- Payment is required at the time of order confirmation
- We accept major credit cards (Visa, Mastercard, American Express)
- Payment is processed securely through our PCI-DSS compliant payment provider
- Payment at delivery is not accepted
4. Delivery
4.1 Delivery Areas
We currently deliver to holiday accommodations in the Costa Blanca region, including Dénia, Jávea, Moraira, Altea, Calpe, Benissa, and surrounding areas. Enter your postcode during checkout to confirm we deliver to your location.
4.2 Delivery Times
- Deliveries are made Monday to Saturday, between 9:00 and 20:00
- You can select an available delivery date and time slot during checkout
- Delivery slots are subject to availability and your geographic area
- Orders must be placed at least 24 hours before the requested delivery time
4.3 Access and Delivery
- You must provide accurate delivery address and access instructions
- Access to the property must be arranged in advance (key code, property manager contact, etc.)
- We will stock refrigerated items appropriately upon delivery
- We are not responsible for failed deliveries due to incorrect addresses or access issues
4.4 Delivery Fees
Delivery fees vary based on order value and delivery location. Free delivery may be available for orders above a certain threshold, as displayed during checkout.
5. Right of Withdrawal and Returns
Important: Under Spanish consumer law (Article 103, Section D of Royal Legislative Decree 1/2007), the right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly, including fresh food and perishable groceries.
5.1 Perishable Goods
Due to the perishable nature of our products (fresh produce, dairy, meat, refrigerated items), these items cannot be returned simply because you have changed your mind. This is in accordance with EU Directive 2011/83/EU and Spanish consumer protection regulations.
5.2 Defective or Incorrect Products
If you receive products that are defective, damaged, or not as described, you are entitled to:
- Replacement of the defective item, or
- A proportionate refund for the affected item
Please report any issues within 24 hours of delivery by contacting us with photos of the affected products.
5.3 Non-Perishable Items
For any non-perishable items (e.g., household goods, sealed beverages), you have 14 calendar days from delivery to exercise your right of withdrawal without giving any reason. To exercise this right, contact us before the deadline expires. You will be responsible for the direct cost of returning the goods.
6. Cancellations
- More than 48 hours before delivery: Full refund
- 24-48 hours before delivery: 50% refund (to cover procurement costs)
- Less than 24 hours before delivery: No refund, as products will have been purchased

7. Product Information and Substitutions
- We make every effort to ensure product descriptions and images are accurate
- Actual products may vary slightly from images due to seasonal availability
- If an item is unavailable, we may substitute with a product of equal or greater value and quality
- You can opt out of substitutions during checkout, in which case unavailable items will be refunded
8. Allergies and Dietary Requirements
Allergy Warning: While we accommodate dietary preferences and allergies where possible, we cannot guarantee that products are free from allergens due to potential cross-contamination during production, handling, or delivery. If you have severe allergies, please contact us before ordering.
Product allergen information is provided by our suppliers and displayed where available. Please always check product labels upon delivery for the most accurate allergen information.
9. Legal Guarantee
Under Spanish law (transposing EU Directive 2019/771), you benefit from a legal guarantee of conformity for goods purchased. For non-perishable products, the seller is responsible for any lack of conformity that becomes apparent within 3 years from delivery. For the first 6 months, any defect is presumed to have existed at the time of delivery unless proven otherwise.
10. Limitation of Liability
- We are not liable for delays or failures due to circumstances beyond our control (force majeure)
- Our liability for any claim shall not exceed the total amount paid for the relevant order
- We are not responsible for the suitability of products for any particular purpose beyond their general use
- Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law
11. Intellectual Property
All content on our website, including logos, text, images, and software, is the property of Holiday Fridge S.L. or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by Spanish law. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Alicante, Spain.
As a consumer, you also have the right to bring proceedings in your country of residence if you reside within the European Union, and you benefit from any mandatory consumer protection provisions of your local law.

14. Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
